Nicholas Paszek

Nicholas Paszek is a Partner at IMD Corporate and heads the firm’s Commercial Litigation and Dispute Resolution practice. He advises businesses, shareholders, directors, investors and high-net-worth individuals on complex, high-value disputes, with particular expertise in shareholder and partnership disputes, contractual claims, construction disputes, insolvency litigation, professional negligence claims and cross-border commercial disputes.

Nicholas acts for a diverse client base ranging from entrepreneurs and owner-managed businesses to developers, investors, multinational companies and international organisations. He is known for combining detailed legal analysis with pragmatic commercial advice, helping clients navigate disputes where legal, financial and strategic considerations are closely intertwined.

His practice regularly involves substantial and complex litigation across a broad range of sectors. Recent matters include acting for the UK subsidiary of an international bottling plant manufacturer in an £11 million dispute concerning alleged defects in a production line; representing a construction company in a £3 million claim arising from the termination of a £12 million development project; advising a founder in a shareholder dispute involving a technology business valued at approximately £25 million; and acting in a multi-jurisdictional LCIA arbitration involving commodities contracts, jurisdictional challenges and losses exceeding £2 million.

Nicholas has expertise in shareholder and director disputes, including unfair prejudice petitions, member register disputes, boardroom conflicts, minority shareholder claims and business ownership disputes. He regularly advises founders, directors, shareholders and investors on complex corporate disputes where commercial relationships have broken down, and significant value is at stake.

He is also highly experienced in construction and development disputes, acting for developers, contractors, subcontractors and investors in adjudications, final account disputes, defects claims, delay claims, bond disputes and professional negligence claims. His work frequently involves coordinating strategic approaches across multiple related adjudications and court proceedings arising from major development projects.

Nicholas advises on a wide range of insolvency-related litigation, including claims involving directors’ duties, wrongful trading, fraudulent trading, misfeasance allegations, creditor disputes and recovery actions. He has acted for insolvency practitioners, directors and investors in disputes arising from distressed businesses, company failures and complex financial arrangements.

Many of Nicholas’s matters contain a significant international element. He has acted in disputes involving parties, assets or proceedings across jurisdictions including the United States, United Arab Emirates, Italy, Cyprus, Poland, Hungary, Portugal, the Czech Republic and Russia. His experience includes international arbitration, cross-border enforcement, jurisdictional challenges and coordinating litigation strategies with foreign lawyers and advisers.

Nicholas holds an LLB and an LLM in International and Commercial Law. He combines strong technical expertise with a practical, commercially focused approach, helping clients identify solutions that support their wider objectives as well as the immediate resolution of the dispute.

• Acting for a founder in a shareholder dispute relating to a software development company valued at approximately £25 million, involving unfair prejudice and member register claims alongside related employment proceedings, leading to a settlement in excess of £900,000.
• Acting in a multi-jurisdictional LCIA arbitration concerning commodities contracts and losses exceeding £2 million, involving proceedings across England, Poland, Hungary and the Czech Republic and a High Court jurisdiction challenge.
• Acting for a major construction company in a dispute arising from the termination of a £12 million development project, including associated adjudications and a contested £1.4 million bond claim.
• Advising in a professional negligence claim arising from an £8 million redevelopment project involving alleged losses exceeding £5 million and multiple related disputes.
• Acting for investors, insolvency practitioners and company directors in claims concerning wrongful trading, fraudulent trading, directors’ duties and insolvency-related disputes.

Outside work, Nicholas is an FA-qualified football coach and enjoys training for Ironman triathlons. When he is not competing or coaching, he enjoys spending time walking his dog.
